1. Legal Information
All services rendered by the DiCaffè – Shop for the customer are exclusively based on the following General Terms and Conditions. Deviating regulations are only valid if they have been agreed upon in writing between DiCaffè – Shop and customer.
2.1 The offers of DiCaffè – Shop on the Internet represent a non-binding invitation to the customer to order goods in the online shop.
2.2 By ordering the desired goods on the internet, the customer makes a binding offer to conclude a purchase contract.
2.3 DiCaffè – Shop is entitled to accept this offer within 2 calendar days by sending an order confirmation. The order confirmation will be sent by e-mail. After fruitless expiry of the 2-day period, the offer shall be deemed to have been rejected.
All articles will be delivered immediately, taking into account the stated delivery time. If an item is not available at short notice, we will inform you by e-mail about the expected delivery time. Delivery is made both within Switzerland and Liechtenstein.
The delivery time within Switzerland and Liechtenstein is usually 3 – 5 working days.
In the event of delays in delivery, for example due to force majeure, traffic disruptions and orders from higher authorities, as well as other events for which we are not responsible, no claim for damages can be made against us.

We accept payments via Paypal, credit card or Bank transfer.
In exceptional cases, the invoice amount can be paid in advance via e-banking or ISR. Bank transfer charges from Switzerland and abroad are to be paid in full by the buyer. You will find our bank details on the e-mail order confirmation. Please state the order number with your transfer so that we can allocate your payment receipt. The delivered goods remain our property until full payment has been received.

Possible within 14 days! Please first send an e-mail to firstname.lastname@example.org stating the invoice number or order number and which items are to be returned or exchanged! DiCaffè.ch does NOT cover the shipping costs for returns and they are at the buyer’s expense! Shipping costs incurred by DiCaffè.ch are also at the buyer’s expense and will be charged to the buyer, even if the entire delivery is returned. All articles from the SALE can NOT be exchanged and NOT be returned!
The risk is transferred to the buyer when the goods are dispatched.
If transport damage to the goods is detected, the recipient must immediately report the damage to DiCaffè-Shop. Other recognisable transport damage must be reported to us in writing within 14 days of receipt of the goods at the latest. We are not liable for defects caused by incorrect handling, normal wear and tear or by external influences. In the event of repairs to the goods carried out by the customer or by third parties without our written consent, the warranty claim against us shall expire.
The ordered goods remain the property of the vendor until full payment has been made. The vendor is entitled to make a corresponding entry in the retention of title register (Art. 715 ZGB). If the customer defaults on payment of the purchase price, the Vendor shall be entitled to take possession of the goods (declaration of withdrawal).
(3) Orders are payable immediately via Paypal or prepayment (e-banking or payment slip).
Information on payment in advance can be found in the e-mail “Order confirmation”, which you will receive after placing your order in the DiCaffè – Shop. Please state the order number with your transfer so that we can allocate your payment receipt.
As far as nothing else arises in the following, further claims of the customer, no matter for which legal reasons, are excluded. DiCaffè-Shop is therefore not liable for damages, which did not occur at the delivery item itself; in particular DiCaffè – Shop is not liable for the loss of profit or for other financial losses of the customer. As far as the contractual liability of DiCaffè – Shop is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents. The foregoing limitation of liability shall not apply if the cause of the damage is based on intent or gross negligence or if personal injury is involved. Furthermore, it shall not apply if the customer asserts claims regulated by law. The provisions of the Product Liability Act shall remain unaffected.
If DiCaffè – Shop negligently breaches a material contractual obligation, the obligation to pay compensation for material damage shall be limited to the typically occurring damage.
If the supplementary performance is carried out by way of a replacement delivery, the purchaser is obliged to return the goods first delivered to the DiCaffè – Shop within 7 days at the expense of the same. The return of the defective goods has to take place according to the legal regulations. DiCaffè – Shop reserves the right to claim damages under the conditions regulated by law.
The period of limitation is two years. The period begins with the delivery of the goods.
Other claims of the buyer – irrespective of the legal ground – are excluded as far as legally permissible. The seller, its auxiliary persons and any vicarious agents shall not be liable for damage not caused to the goods themselves, in particular not for consequential damage, loss of profit or other financial losses of the buyer.
DiCaffè.ch shall only be liable for damages other than those resulting from injury to life, body and health if such damages are due to intentional or grossly negligent conduct or culpable breach of an essential contractual obligation by DiCaffè.ch or its vicarious agents. An essential contractual obligation is an obligation the fulfilment of which enables the proper performance of the contract in the first place and on the observance of which the purchaser may regularly rely. Any further liability for damages is excluded. Claims arising from a guarantee given by DiCaffè.ch for the quality of the object of purchase and the product liability law remain unaffected by this.According to the current state of technology, data communication via the internet cannot be guaranteed to be error-free and/or available at all times. We are therefore not liable for the availability of our Internet shop at all times.

The data you provide will only be used by us to process your orders. All your data will be treated as strictly confidential. We only pass on data to third parties (e.g. shipping services) if this is necessary for order processing. The order data is transmitted in an encrypted and secured form, but we accept no liability for data security during these transmissions via the Internet (e.g. due to technical faults on the part of the provider) or for any criminal access by third parties to files on our Internet site. Access data for the customer login, which are transmitted to the customer at the customer’s request, are to be treated as strictly confidential by the customer, as we do not accept any responsibility for the use and application of this data.
All third-party logos, images and graphics displayed are the property of the respective companies and are subject to the copyright of the respective licensors. All photos, logos, texts, reports, scripts and programming routines displayed on these pages, which are proprietary developments of DiCaffè or have been prepared by us, may not be copied or otherwise used without our consent. All rights reserved.
We have no influence if articles are taken out of the programme by our suppliers and are therefore no longer available or have been changed in type and design. Should we be offered a replacement article by the supplier, we will inform you of this. A claim for damages due to articles that are no longer available cannot be asserted against us. We reserve the right to change the prices of individual articles.
Vouchers can only be used for payment by stating the voucher code and until the expiry date. Any claim for cash payment is excluded. Vouchers are not cumulative.
By placing an order, the General Terms and Conditions of the online shop are accepted. Should any provision of these General Terms and Conditions be invalid for any reason whatsoever, this shall not affect the validity of the remaining provisions. Verbal agreements require written confirmation. Place of performance and jurisdiction is, unless otherwise provided by law, Zurich – Switzerland.
